Fox and Marvel have withdrawn a case filed in June against Sony and Revolution film ZOOM, reports VARIETY. The suit claimed the Tim Allen comedy is too similar to the X-MEN franchise and that its release two weeks prior to X3 was an attempt to ride the promotion of the third X-MEN film.
Since then, Revolution has moved ZOOM from May 13 to August, because it did not want to challenge Warner Bros. THE POSEIDON ADVENTURE, which shifted from May 5 to May 13. In addition, Sony and Revolution has made some minor script changes in direct response to the suit, per recommendations from lawyer Bert Fields. The changes were also made to insure the film received a PG rating.
ZOOM follows an out-of-shape former superhero who has lost his powers and is unwilling to return to heroics to train a group of kids in becoming the next generation of superheroes.
